What the November 2026 Federal Hemp Cliff Means for Buyers

Federal law that defined hemp for the last seven years is about to be rewritten. Here's a buyer's-eye view of what's happening, when, and how to read the next four months.

What changed

The 2018 Farm Bill defined "hemp" by the concentration of Δ9-THC alone: 0.3% or less of dry weight, federally legal. That single number is what made the modern hemp-derived cannabinoid market — Δ8 carts, THCA flower, HHC gummies, and everything else — possible. The plants and products contained meaningful intoxicating compounds; they just weren't Δ9-THC, so they slipped through the federal definition.

Section 781 of the FY26 Agriculture Appropriations Act, signed into law November 12, 2025, rewrites that definition. Starting November 12, 2026, "hemp" is defined by total THC — calculated as (THCA × 0.877) + Δ9-THC. The 0.3% threshold applies to that combined number. Consumables add a second cap: no more than 0.4 mg of total THC per container.

Why that breaks most of what you buy today

THCA flower is the clearest example. THCA is the non-intoxicating acid form of THC; smoking or vaping it converts most of it to Δ9-THC via decarboxylation. Under the old rule, the test was performed on the raw flower, and THCA didn't count. Under the new rule, the THCA is multiplied by 0.877 (the conversion ratio) and counted as if it were already Δ9-THC. A flower bud testing at 20% THCA — totally normal in this market — comes out at roughly 17.5% total THC under the new math. That's 58 times the new federal limit.

The 0.4 mg/container cap on consumables is even more aggressive. A typical 10 mg Δ9 gummy is 25× the new limit. A 100 mg gummy is 250×.

What stays legal

• CBD products — CBD isn't THC and doesn't decarboxylate to THC. Anything CBD-dominant with negligible THC content stays federally hemp.
• CBG, CBN, CBC, and other non-THC cannabinoids — same reasoning. These minor cannabinoids weren't ever the target.
• Very low-dose Δ9 products — anything that already meets the 0.4 mg/container cap (some microdose tinctures, for example) is fine.
• Industrial hemp uses — fiber, seed, grain. Never affected.

What goes federally illegal on November 12, 2026

• THCA flower and pre-rolls
• Δ8-THC vapes, carts, edibles, and tinctures
• HHC, THCP, and other intoxicating analogs
• Δ9 gummies, drinks, and edibles dosed above 0.4 mg/container
• Live resin and high-potency concentrates

What to expect in the next 4 months

Expect three things, in rough order:

1. Aggressive clearance pricing. Brands holding non- compliant inventory are already discounting to move it before the cliff. Wholesale flower has already dropped 40–50% from 2024 highs. Retail follows.
2. Affiliate program churn. Payment processors and affiliate networks will start de-risking ahead of November. Some merchants will lose MIDs early; others will quietly close their affiliate programs in October to avoid post-cliff liability.
3. State-level overlays. California's AB 8 already banned intoxicating hemp in October 2025; New Jersey, Tennessee, and others have similar bills moving. State bans don't wait for the federal cliff.
